Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Elephruit website, bookmarklet, phone scanner, and related services (together, the "Service"), operated by Elephruit LLC ("Elephruit," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You may use the Service only if:

You are at least 13 years old. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms.
You are located in, and access the Service from, the United States. The Service is offered only to users in the United States and is not directed to users in any other country.
You are not barred from using the Service under applicable law.

By using the Service you represent and warrant that you meet these requirements.

2. What the Service does

The Service lets you scan the PDF417 barcode on a driver's license or state ID using your phone and auto-fill the decoded data into a web form open on your computer. Scanned data is end-to-end encrypted between your devices and is not stored on our servers. See our Privacy Policy for details.

3. Your responsibilities and acceptable use

You are solely responsible for how you use the Service and for complying with all laws that apply to you. You agree that you will:

Only scan an identity document when you have a lawful basis and the necessary authorization or consent to collect and process that person's information.
Use any personal information you obtain through the Service only for lawful, legitimate purposes, and handle it in accordance with all applicable privacy, data-protection, and identity-theft laws.
Not use the Service to harass, defraud, impersonate, surveil, or harm any person.
Not attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Service, and not use it in violation of any law or the rights of others.

You are responsible for maintaining a lawful basis for each scan. We are not responsible for your collection or use of any identity information.

4. Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. Notify us promptly of any unauthorized use.

5. Plans, billing, and cancellation

Free trial. New accounts include a limited number of free scans. No payment card is required for the trial. Trial scans are a one-time allotment; they do not renew.
Scan allowances. Metered plans (such as Solo) include a set number of scans per billing period; that allowance refreshes at the start of each period and unused scans do not roll over to the next period. Unlimited plans have no scan cap.
Paid subscriptions. Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor, Stripe. Subscriptions renew automatically until cancelled.
Upgrades and proration credit. If you upgrade from a paid metered plan to an Unlimited plan mid-period, we apply a one-time account credit for the unused portion of the metered period you already paid for. The credit is calculated as the fraction of your scan allowance that remained unused when you upgraded, valued at the price of your metered plan (for example, if 10 of 30 scans remained, one-third of your metered plan price), and is applied toward your first Unlimited invoice. The credit is granted once per account, is not redeemable for cash, and has no value except as a credit against Elephruit charges. Downgrades and other plan changes are not prorated.
Taxes. Prices are exclusive of taxes unless stated. Applicable sales tax is added at checkout where required.
Cancellation. You may cancel at any time from your account's billing portal. Cancellation stops the next automatic renewal; it takes effect at the end of your current paid period. You keep full access to your plan until the end of the period you have already paid for, after which the subscription ends and no further charges are made. Cancellation does not retroactively refund the current period, and unused scans are not refunded or credited on cancellation.
Refunds. Except where required by law, payments are non-refundable. We may change plans and pricing prospectively with notice.

6. Intellectual property

The Service, including its software, design, and content, is owned by Elephruit and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works except as permitted.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that scans will be complete or error-free, that any web form will be filled correctly, or that the Service will be uninterrupted or secure. You are responsible for reviewing all data before relying on it.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEPHRUIT AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US$100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless Elephruit from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of any third party — including any claim relating to your collection or use of identity information.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will survive.

11. Governing law and disputes

These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in the United States, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally. Nothing in these Terms limits rights you may have that cannot be waived under applicable state or federal law.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
